§ 1. General provisions
1.1. These Terms set out the rules for the operation and use of the Beyond the Peak website available at beyondthepeak.pl (the “Website”).
1.2. The owner and administrator of the Website is e-Place Tomasz Budzyński, ul. Siemieńskiego 17a/5, 35-203 Rzeszów, Poland, entered in the register of entrepreneurs kept by the District Court, VAT ID (NIP): 5170364287, REGON: 181042943 (the “Administrator”).

1.4. Using the Website means accepting these Terms in full.
§ 2. Definitions
Administrator – e-Place Tomasz Budzyński, owner and operator of beyondthepeak.pl.
Contact form – a form available on the Website that allows sending a message to the Administrator.
Sign-up form – a form that allows subscribing to the newsletter and receiving free materials.
Free materials – digital content shared by the Administrator after subscribing to the newsletter (to-do lists, guides, checklists).
Newsletter – emails sent regularly with travel content and information about new materials.
Terms – this document, setting out the rules for using the Website.
Website – the Beyond the Peak website available at beyondthepeak.pl.
Content – all materials available on the Website, including articles, photos, videos and guides.
User – a natural person, legal person or organisational unit without legal personality using the Website.
§ 3. Rules for using the Website
3.1. The Website provides services electronically, free of charge, to all Users.
3.2. Using the Website requires:
- A device with internet access
- A web browser supporting JavaScript and cookies
- An active email account (for the newsletter and materials)
3.3. The User undertakes to:
- Use the Website in accordance with the law and good practice
- Refrain from actions that could disrupt the operation of the Website
- Not post unlawful content in contact forms
- Respect copyright and intellectual property rights
3.4. It is prohibited to:
- Use the Website in a way that could damage, disable or overload the servers
- Attempt unauthorised access to the Administrator’s systems
- Copy, distribute or modify Content without consent
- Send spam or advertising content without consent
§ 4. Newsletter and free materials
4.1. The Administrator runs a newsletter containing:
- Travel content and guides
- Information about new articles on the Website
- Travel inspiration and practical tips
4.2. Subscribing to the newsletter requires providing a first name, an email address and consent to the processing of personal data.
4.3. After subscribing, the User receives access to free digital materials in PDF format, intended for personal use only.
4.4. The User may unsubscribe at any time by:
- Clicking the link in a received email
- Contacting the Administrator at hello@beyondthepeak.pl
4.5. The Administrator reserves the right to suspend or discontinue the newsletter for technical or organisational reasons.
§ 5. Copyright and intellectual property
5.1. All Content available on the Website (texts, photos, videos, graphics, layouts) is protected by copyright and is owned by the Administrator or used under appropriate licences.
5.2. The User may use the Content solely for personal, non-commercial purposes.
5.3. It is permitted to:
- Browse and read Content on the Website
- Save copies for personal use
- Quote short excerpts with attribution
5.4. It is prohibited to:
- Copy all or a substantial part of the Content
- Use the Content for commercial purposes without consent
- Modify or process the Content
- Remove copyright notices
5.5. Redistribution, sale or sharing of materials with third parties is prohibited.
5.6. Copyright infringement may result in civil and criminal liability.
§ 6. Liability
6.1. The Administrator makes every effort to keep the information on the Website current and reliable, but is not liable for:
- Decisions made by Users based on information from the Website
- The outcome of trips planned according to advice from the Website
- Changes in regulations, travel conditions or prices after an article is published
6.2. The Content on the Website is informational and educational. It does not constitute professional travel, legal or medical advice.
6.3. The Administrator is not liable for:
- Interruptions in the availability of the Website for technical reasons
- Actions of third parties (hackers, internet service providers)
- Content available on websites linked from the Website
- Data loss caused by a technical failure
6.4. The Administrator’s liability for damage arising from the use of the Website is limited to the actual damage, but no more than PLN 1,000.
6.5. The User uses the Website at their own risk.
§ 7. Personal data protection
7.1. The rules for processing personal data are set out in a separate Privacy Policy available on the Website.
7.2. The Administrator processes personal data in accordance with the GDPR and Polish law.
§ 8. Complaints procedure
8.1. Complaints regarding the operation of the Website should be submitted electronically to: hello@beyondthepeak.pl
8.2. A complaint should include:
- The User’s contact details
- A description of the problem or irregularity
- The expected way of handling the complaint
8.3. The Administrator considers complaints within 14 days of receipt.
8.4. The response to a complaint will be provided in the way indicated by the User.
§ 9. External links
9.1. The Website may contain links to third-party websites.
9.2. The Administrator is not liable for the content, privacy policy or practices of third parties.
9.3. Use of third-party websites is governed by the rules set by their owners.
9.4. Placing a link does not constitute a recommendation or endorsement of third-party content or services.
§ 10. Changes to the Terms
10.1. The Administrator reserves the right to introduce changes to the Terms.
10.2. Users will be informed about changes through:
- Publication of a new version on beyondthepeak.pl
- An email to newsletter subscribers (for material changes)
10.3. Changes take effect on the day the new version of the Terms is published.
10.4. Continued use of the Website after changes are introduced means acceptance of the new Terms.
§ 11. Final provisions
11.1. In matters not covered by the Terms, Polish law applies, in particular:
- The Act on Providing Services by Electronic Means
- The Consumer Rights Act
- The Civil Code
11.2. Any disputes will be resolved by the competent Polish court.
11.3. If any provision of the Terms is found invalid, the remaining provisions remain in force.
11.4. The Terms are available on the Website in a form that allows their content to be read, obtained and stored in the ordinary course of business.
